If you live in a homeowner’s association, and you violate the rules, the homeowner’s association has the right to impose a fine. However, they must strictly follow the law in doing so.

The law requires a proposed fine in writing. It requires a notice to you at least 14 days before the violation committee will meet about the proposed fine, telling you when and where the committee will decide it. It tells you you have an opportunity to defend yourself at the meeting and that the committee must be composed of members who are not related or otherwise connected to the Board members. They must be independent people consisting of three people.

If the association does not strictly follow the law in imposing the fine, the fine will not be valid.
